The following Terms & Conditions are comprehensive and inclusive, as applies to each service or product offered through JeanSlatter.com, CreativeMystic.com and all associated websites of Jean Slatter’s, also and herein referred to as Jean Slatter Network. Wherein a particular term or condition does not apply to an individual product or service due to the nature of the item or delivery method, all other terms and conditions still apply.

The information contained in or made available through the Jean Slatter Network, what is posted here or shared in Programs, Events or Private Sessions does not replace professional medical diagnosis, treatment, cure or advice. You should always consult a qualified healthcare professional with questions about any medical condition. If you have or suspect you may have any disease, disorder or mental or medical condition, please seek the care of the appropriate medical or mental health provider as products and services offered through this website are no substitute for such care, nor are they purported to be as such.

Payments & Refund Policy

Private Coaching:

No refunds on services rendered. Services must be paid in full prior to the scheduled session unless arrangements are otherwise made and agreed to by Jean Slatter. Any rescheduling or cancellations less than 2 full Business Days in advance may result in forfeiture of prepaid session. Full refund will be given to prepaid sessions if cancellation is requested at least 2 business days prior to the session.

 

Digital Products:

Requests received within 30 days or less from Product Purchase will receive a Full Refund. Users requesting refunds on Digital Programs agree to delete any program content and stop using program downloads, tools, techniques, processes and methods on receipt of refund. Users also agree to never digitally pass on any product to an unpaying person. No refunds after 30 days.

 

Certification Programs:

The Creative Mystic Intuitive Certification Program is a 3 month program.  You have 30 days to experience and try it out. If after 30 days from the start date of the program, you do not wish to continue with the program, you will be refunded the remaining 2 months (if pre-paid).  Neither the first month nor the non-refundable deposit will be refunded.  Your name will be deleted from access to the program.

 

If you wish to continue having access to the program you are required to make each of your payments on time. Attendance to the live sessions is your responsibility and absence does not constitute a refund of any kind.

 

The Higher Guidance Life Coach Certification Program is a 6 month program and divided into two 3 month sections. The first 3 months is the Creative Mystic Intuitive certification program and the second 3 months is the HGLC Program.  For the first section – CMI – you have 30 days to experience and try it out. If after 30 days from the start date of the program, you do not wish to continue with the program, you will be refunded any prepaid amount beyond the first month portion minus the non-refundable deposit.  Your name will be deleted from access to the program.

 

For the second section – HGLC – you have until three weeks prior to the start date of the section to ask for a refund of the HGLC section.  Only the prepaid portion beyond the first 3 months -CMI section – minus the non-refundable deposit, will be refunded.  After three weeks prior to the start of the HGLC section, no refunds will be given for any portion of the program.  In other words, we expect you to know within 2 months into the program if you wish to continue or not onto the HGLC section. If you don’t, you must contact us prior to 3 weeks before the start of the HGLC section.

Please note that refunds are determined at the full tuition price – not at any discounted special you may have been able to obtain.

 

It is your responsibility to make each of your payments on time whether or not you are participating and keeping up with the group.  Attendance to the live sessions is your responsibility and absence does not constitute a refund of any kind.

 

However, if your teacher notices that you have not been attending the live sessions and keeping up with the materials, the teacher may decide NOT to issue a certification of completion even though you have made your payments in full.

 

In other words, paying for the program does not mean you will graduate with a certificate. Full participation in the program is required to get the most out of the program.

 

Ongoing Monthly Membership Programs:

The membership programs are an automatic monthly payment program that you agree to.  No refunds will be given for any portion of the month after your payment has been received. You are in control of terminating your membership by stopping the automatic payment for the following month.

Our programs take a lot of work and discipline just like any worthwhile endeavor or professional continuing education program.

 

As stipulated by law, we cannot and do not make any guarantees about your ability to get results or earn any money with our ideas, information, tools or strategies.  We just want to help by giving great content, direction, and strategies.

Restrictions for Use of All of Our Online Materials

Use of materials and content on the Jean Slatter Network including text, software, names, logos, trademarks, service marks, trade names, images, photos, illustrations, audio clips, video clips, and music are copyrighted intellectual property. Copyright applies to all materials and processes under the Jean Slatter Network, as well as any all Programs or Products past or future offered by Jean Slatter through her Network.

 

All usage rights are owned and controlled by Jean Slatter Network. All content contained therein are copyrighted and trademarked materials, which cannot be shared, reproduced or transmitted in any form or by any means electronic or mechanical or by an information storage or retrieval system without permission in writing from Jean Slatter or her authorized agent. Users further agree to not share Jean’s techniques, tools or methods without giving due credit and reference to Jean, including direct links back to her products. Program purchasers agree that program use and membership access is only for use of a single individual and may not be shared. You, the visitor, may download Online Materials for non-commercial, personal use only provided you:

1) retain all copyright, trademark and propriety notices,

2) make no modifications to the materials,

3) do not use the materials in a manner that suggests an association with any of our products, services, events or brands, and

4) do not download quantities of materials to a database, server, or personal computer for reuse for commercial purposes.

You may not, however, copy, reproduce, republish, upload, post, transmit or distribute Online Materials in any way or for any other purpose unless first getting written permission from Jean Slatter or her authorized agents. Neither may you add, delete, distort or misrepresent any content on the Site. Any attempts to modify any Online Material, or to defeat or circumvent our security features is prohibited.

Everything you download, any software, plus all files, all images incorporated in or generated by the software, and all data accompanying it, is considered licensed to you by Jean Slatter or her company for your personal use only. We do not transfer title of the software to you. That means that we retain full and complete title to the software and to all of the associated intellectual-property rights. You’re not allowed to redistribute or sell the material or to reverse-engineer, disassemble or otherwise convert it to any other form that people can use.

HGLC Grad Membership Terms & Conditions

We are glad you have decided to join our HGLC Graduate Membership community, and we look forward to your participation. Before you begin, however, we ask that you review this Membership Agreement because you must agree to its terms to become a Member. It is important that you understand both the services we provide as well as your obligations.

 

The HGLC Graduate Membership is an exclusive membership only available to Graduates of the HGLC program. However this contract is binding to all HGLC endeavors which consists of the CreativeMystic.com, JeanSlatter.com, HigherGuidanceLifeCoach.com and any other web site and membership service that we identify as a part of the Creative Mystic Network or HGLC Network, any future mobile versions of our websites, and any future apps that we offer (for example, apps available through iTunes and on Facebook).

 

This Membership Agreement is an agreement between you and the JeanSlatter.com and CreativeMystic.com (referred to in this Membership Agreement as “the HGLC Network,” “us,” “our” and “we”). This Membership Agreement applies to the various trademarked and copyrighted communication and personalization tools and services offered on the HGLC program that are part of our Network.

 

Participation

 

Participation in the HGLC Graduate Membership is only available to graduates of the  HGLC program who sign up as Members by agreeing to be bound by this Membership Agreement.

 

Your membership begins when you sign up and pay the monthly fee or as agreed to by special considerations.  Your membership ends when the Member decides to end the membership and stop payments. No refunds will be given for partial months.

 

As used in this Membership Agreement:

“Members” means you (when you have accepted this Membership Agreement) and the other members of the HGLC Network.

 

You acknowledge and agree that by accepting this HGLC Graduate Membership Agreement and completing the registration process, you are becoming a member of the HGLC Network and are agreeing to the following:

 

General

 

We reserve the right, in our sole discretion and at any time, to make changes to this HGLC Graduate Membership Agreement. (We also reserve the right, in our sole discretion and at any time, to waive or modify any of the terms of this HGLC Graduate Membership Agreement as they apply to a specific item of HGLC or as they apply to a specific Member, without affecting the application of these terms to any other Members.) Changes will be effective when made and the updated Membership Agreement (or applicable policy) is posted when appropriate on the HGLC Membership Network; provided, however, that no such change shall be applicable to any dispute between you and us that arises prior to the time such change is effective. Accordingly, you should visit this page periodically to review its provisions. As described below, any Member who violates this Membership Agreement may be banned permanently from using some or all of the HGLC Graduate Membership services. HGLC Network reserves and retains all rights and remedies provided by law or equity to redress any violation of this Membership Agreement.

 

If any provision of this Membership Agreement shall be deemed invalid, void or for any other reason unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the balance of this Membership Agreement.

 

We retain, however, the right to modify or remove messages or other material that we, in our sole discretion, consider infringing, offensive, abusive, defamatory, obscene, stale, or otherwise unacceptable. We also reserve the right to edit materials for any other reason. Whether or not we modify or remove such material, users remain solely responsible for the content of their messages or postings. By posting on the Sites, you grant (or warrant that the owner of such rights has expressly granted) us and/or relevant affiliated companies the worldwide, perpetual, nonexclusive right to use your questions, comments, and postings, in their original or edited form, in television programs, books, articles, commentaries, or in any other medium now known or later developed. You also warrant that you own or otherwise control all of the rights to the content you have posted and that the public posting and use of such content by us will not infringe the rights of any third party. Additionally, you warrant that any “moral rights” in posted materials have been waived. You are not entitled to any compensation for any materials you may post on the Sites.

 

We may, at our discretion, suspend or terminate the registration of any forum user or general user who violates any of these terms of use of use, any of the forum member guidelines or for any other behavior that we in our discretion believe is inappropriate.

 

The information, services, products, claims, seminar topics, and materials on our Sites are provided “as is” and without warranties of any kind, either expressed or implied. We disclaim all warranties, expressed or implied, including but not limited to implied effectiveness of the ideas or success strategies listed on this site as well as those that are provided in our products or to our participants at our events.

 

Any content submitted by you to us  — for example, the submission of a letter to our editors, to our compliments & success stories or to help, or a submittal directly to our staff of feedback, errors, questions or comments — is governed by this Membership Agreement.

 

While we make reasonable efforts to ensure that the HGLC Graduate Membership services are available at all times, we do not guarantee that the HGLC Graduate Membership services will be uninterrupted or error-free, and we do not guarantee that Members will be able to access or use all the HGLC Graduate Membership services or all of their features at all times.

 

We may change, suspend or discontinue any (or all) Membership services, or any of their features, at any time. We may also impose limits on the use of or access to certain features or portions of the HGLC Graduate Membership services, or restrict your access to any part or all of the HGLC Graduate Membership services, in all cases however the Members will be notified of major changes and given the option at ay time to continue with the membership or stop.

 

Member Identification and Use of Registration Data

 

As part of the registration process, you must select a username and password. You agree to register only once using a single username. The information that you supply during the registration process must be accurate and complete and you agree you will not (i) register on behalf of another person; (ii) register under the name of another person or under a fictional name or alias; (iii) choose a username that constitutes or suggests an impersonation of any other person (real or fictitious) or entity or that you are a representative of an entity when you are not, or that is offensive; (iv) choose a username for the purposes of deceiving or misleading our visitors and/or the Moderators as to your true identity; or (v) choose a username that incorporates a solicitation (e.g., yoursitedotcom).

 

Your Forums profile is only displayed to other Members. Your email address included in your Forums profile will remain private and will not be displayed, unless you change profile settings to request that it be displayed.

 

Keeping Your Personal Information Private

 

You are responsible for maintaining the confidentiality of your password. You are responsible for all usage and activity in the Membership services through your username and password, including use of your username and password by any third party. Your account is unique to you and may not be transferred to any third party. You should notify us of any known or suspected unauthorized use of your username and password.

 

Member Conduct

 

We welcome all points of view on HGLC matters. However, although interactions within the Forum occur in cyberspace, everyday manners apply. Please respect and interact with fellow Members as you would in any public arena. Civility and respect underlie the success of an on-line community; if you wish to take issue with the statements of other Members or the Moderators, please engage in healthy, mature debate and not immature behavior or name-calling. While we want to maintain an inviting environment for all visitors, disruptive conduct, such as off-topic comments in a topic-oriented discussion in the Forums, is not allowed. Neither is “spam” (e.g., posting your message in multiple places throughout the Forums).

 

The Forum areas for the exchange of information and, in some areas, advice. Questions asked may be answered within those areas.

 

Profanity, Harassment and Other Inappropriate Conduct

 

You may not submit content that is indecent, profane (including masked profanity where symbols, initials, intentional misspellings or other characters are used to suggest profane language), obscene, pornographic, abusive, threatening, misleading, illegal or defamatory, or any material that interferes with the ability of others to enjoy the Membership and Forum.

 

You also may not submit content that consists of or contains software viruses, political campaigning or commercial solicitation. You may not use a false e-mail address, impersonate any person or entity (including any other Member or Moderator), or otherwise mislead as to the origin of your content.

 

In addition, we do not tolerate Members’ harassing, threatening or embarrassing other Members, including harassment or denigration based on age, gender, race, religion, national origin, sexual orientation or disability, marital status or veteran status, or the stalking of other Members (“cyberstalking”). You agree not to engage in this behavior.

 

Illegal and Objectionable Activities

 

We do not allow the promotion of illegal conduct or activities or fraudulent schemes in the HGLC Graduate Membership and Forum. You also agree to not engage in any illegal activity in connection with your participation in or use of the Membership services.

 

Rights of Third Parties

 

You may not submit content that infringes in any manner on the copyright, trademark or intellectual property rights of any person or entity, or that contains any confidential or proprietary information of any person or entity, or that otherwise violates the legal rights of any person or entity. In certain areas of the Membership services, you may insert hyperlinks in your content to permit members to access copyrighted materials — but, except for quotes of reasonable length, you may not post such materials in the Forum. You may not use the Forum to distribute unauthorized copyrighted material, including photos, videos, artwork text, recordings, designs or computer programs.

 

You may not submit content that contains personally identifiable information about other people, such as their phone number, street address or email address, or information about other people that could result in an invasion of their privacy or their harassment.

 

We disclaim any responsibility or liability for copyrighted materials posted in the Membership services.

You may not harvest or collect information about other Members from the HGLC Network, including usernames, or use that information for the purpose of sending unsolicited bulk communications. You may not use or provide to any person or entity, whether or not for a fee, any directory of or information regarding other Members.

 

Promotions and Solicitations

 

You agree that, except with our prior consent, you will not upload, post, email, transmit or otherwise use any Membership service to make or distribute any unsolicited or unauthorized advertising, contests, sweepstakes, survey requests or promotional materials or implore visitors to take actions that are intended to further a personal purpose. You agree you will not use information supplied within the Membership services to do any of the foregoing, by email or any other method. You agree to not gather public email addresses from Member profiles for any purpose.

 

Including a link in content to another Web site is permissible when appropriate in the context of answering a question posed by another Member, but not for the purpose of promoting other communities or third-party services or products. The Moderators will remove any link they believe does not provide value to members.

 

Ideas Submitted to Membership services

 

From time to time, we provide opportunities for Members to submit to us ideas and improvements related to HGLC Web sites, services and technology.

 

You agree that: (1) your submission and your expression of your ideas and/or improvements will automatically become the property of and owned by HGLC Network; (2) HGLC Network may use or redistribute your submission and its contents for any purpose and in any way and without any restrictions; (3) there is no obligation for the HGLC Network to review any submission; (4) there is no obligation to keep any submission confidential, and (5) the HGLC Network shall have no obligation to you or contract with you, implied or otherwise.

 

You grant to us and our designees a perpetual, irrevocable, fully assignable and sublicensable, non-exclusive fully-paid up and royalty free license to use any ideas, expression of ideas or other materials you submit (collectively, “Materials”) to us, without restrictions of any kind and without any payment or other consideration of any kind, or permission or notification, to you or any third party. The license shall include, without limitation, the irrevocable right to reproduce, publish, create prepare derivative works from, combine with other works, modify, alter, adapt, edit, reformat, translate, distribute copies, display, perform, provide to third parties, license the Materials, and all rights therein, in any name of the HGLC Network or its designees throughout the universe in perpetuity in any and all media now or hereafter known.

 

The license shall also permit us and our designees to use portions of the Materials you submit, rerecord or modify any audio tracks, videos or visual images you provide, rewrite any Materials you submit, and/or incorporate other materials, either created by us and our designees or licensed from third parties, with the Materials you submit. Any such works shall be deemed Materials owned by us and shall not be subject to your approval or payment by us of any compensation to you.

 

You agree that the Materials you submit: (i) are original with you, and (ii) do not violate and will not violate the rights of any third party or any local, state, national or foreign law, including any right of publicity, right of privacy or any other proprietary right.

 

You acknowledge and agree that the relationship between you and the HGLC Network is not a confidential, fiduciary, or other special relationship. We shall have the right, but not the obligation, to use your name, likeness, biography and other information about you in connection with any use of the Materials you submit.

 

By making a submission, you acknowledge and agree that we and our designees may create on our own or obtain many submissions that may be similar or identical to the Materials you submit through Forums or other channels and means. You hereby waive any and all claims you may have had, may have, and/or may have in the future, that the Materials accepted, reviewed and/or used by us and our designees may be similar to your Materials.

 

Termination of Membership

 

Please be aware that your membership may be revoked if you fail to abide by the terms of this Membership Agreement. We also reserve the right to disable or terminate a Member’s account, without notice, if there is a stoppage in the payment by the Member.

 

Community Security; Violations of Law

 

Violations of system and network security are prohibited, and may result in criminal and civil liability. Examples of system and network security violations include the following:

•Any automated use of the system

•Use of software that allows your account to stay logged on while you are not actively using the account

•Unauthorized access to or use of data, systems or networks, including any attempt to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures without the express authorization of the owner of the system or network.

 

We may investigate incidents involving such violations, any violations of this Membership Agreement that may constitute or have the potential to constitute violations of law, and any activity by Members on the HGLC Network that constitute or may constitute violations of law. You understand that we may report any such activity to, and cooperate with, law enforcement, with or without receipt by us of a subpoena or other legal process.

 

Representations and Warranties

 

You represent and warrant to us that all of the information provided by you to us to register as a Member and participate in the Membership services is correct and current; and that you have all necessary right, power and authority to enter into this Membership Agreement, to perform the acts required of you hereunder, and to submit your content in accordance with the requirements of this Membership Agreement.

 

Damages; Indemnification

 

You agree that you will be responsible for any damages resulting from any violation of this Membership Agreement. You further agree to indemnify and hold HGLC Network and our subsidiaries, affiliates, officers, directors, agents, and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your violation of this Membership Agreement, or any breach of any representation made by you in this Membership Agreement, or any violation of any law or the rights of a third party (including any right of publicity, right of privacy, intellectual property right, or any other proprietary right) that occurs in connection with your use of the Membership services.

 

Choice of Law and Forum; Attorneys’ Fees

 

This Membership Agreement and the rights of the parties herein shall be governed by and construed in accordance with the laws of the State of California, excluding its conflicts of law rules. You agree that, unless expressly waived by us or we bring an action in a different jurisdiction, the exclusive jurisdiction for any claim or action arising out of or relating to this Membership Agreement, the Membership services, or your or any Member’s use of or participation in the Membership services shall be in the state or federal courts located in the County of Sacramento, State of California, and you further (i) agree not to file or bring any claim or action in a different jurisdiction, and (ii) agree and submit to the exercise of personal jurisdiction of such courts for the purpose of litigating any such claim or action. You also agree that in the event of any action to enforce or interpret this Membership Agreement, the prevailing party shall be entitled to collect its reasonable attorney fees.

 

Intellectual Property

 

You must obtain written permission from us or any other entity who owns intellectual property on the Sites before you may publish, distribute, display, or commercially exploit any material from the HGLC Graduate Membership. By using the HGLC Graduate Membership, you agree to abide by all copyright notices or other posted restrictions.  These terms of use apply only to our HGLC Network, and not to the sites of any other companies or organizations, including those we link to. We do not maintain, create, endorse, or take any responsibility for the contents, advertising, products or other materials made available through any other site, including those we link to.

 

Affiliate Sites

 

Under no circumstances will we be held responsible or liable, directly or indirectly, for any loss or damage that is caused or alleged to have been caused to you in connection with your use of any content, goods or services available on any other site. Other sites may link to our Sites by permission only. To seek our permission, you may contact us at the information above. We reserve the right to rescind any permission granted to you or any organization in which we approve linking to our Sites, and to require termination of any such link to any of the Sites, at our discretion at any time.

 

Neither we nor any of our respective licensors or suppliers warrant that any functions contained in the Sites will be uninterrupted or error-free, that defects will be corrected, or that the Sites or the server that makes them available are free of viruses or other harmful components. Neither we nor any of our respective licensors or suppliers warrant or make any representations regarding the use or the results of the use of the services, products, information or materials in this site in terms of their correctness, accuracy, reliability, or otherwise. You (and not we or any of our respective licensors or suppliers) assume the entire cost of all necessary servicing, repair or correction to your system.

 

Applicable law may not allow the limitation or exclusion of liability or incidental or consequential damages (including but not limited to lost data), so the above limitation or exclusion may not apply to you. In no event shall the total liability to you by us or any of our licensors or suppliers for all damages, losses, and causes of action (whether in contract, tort, or otherwise) exceed the amount paid by you to us, if any, for accessing the Sites.
